1. Acceptance of Terms
By downloading, installing, browsing, or using any website, mobile application, or related service provided by Studio POMEKURI (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services.
2. The Services
We provide mobile applications and related services for diaries, notes, photo records, inventory management, household expense and subscription tracking, vehicle maintenance, pet walking logs, collection management, lifestyle reflection, image creation, and similar personal productivity uses. We may add, remove, modify, suspend, or require updates for features from time to time.
3. App Store Terms
If you download our apps from the Apple App Store, Google Play, or another distribution platform, your use is also subject to the applicable store terms, payment terms, and refund policies. The store operator is not responsible for the Services, support, content, warranties, or claims.
4. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal and lawful purposes, subject to these Terms. You agree not to:
- Use the Services in any way that violates applicable laws, regulations, third-party rights, or public order
- Reverse engineer, decompile, disassemble, modify, or create derivative works from the Services
- Remove or bypass proprietary notices, copyright notices, security features, or access controls
- Interfere with, overload, or disrupt the Services, ads, purchases, sync features, or related systems
- Transmit or store harmful, infringing, illegal, false, or malicious content or code
- Use the Services as a substitute for professional medical, legal, accounting, investment, driving, or emergency advice
5. User Content and Data Management
You retain ownership of text, photos, location information, records, tags, ratings, inventory data, expenses, product data, vehicle data, pet data, health and lifestyle records, and other content you create, enter, capture, upload, store, or sync using the Services. You are responsible for having the rights to use that content, complying with laws and third-party rights, keeping your content accurate, managing backups, deleting content, and controlling device permissions. We may process your content as necessary to provide, sync, back up, support, and improve the Services.
6. Device Features, Location, Photos, and Notifications
Depending on the app and feature, the Services may use camera, photo library, location, notifications, iCloud/CloudKit, advertising tracking permission, and other device features. You can manage these permissions in your device settings. If a permission is disabled, some features may not work, records may be incomplete, and sync or notifications may not occur.
7. Health, Medical, and Safety Disclaimer
Apps such as KIRYOKU, Alc.Note, FlareLog, and WanStep may allow you to record energy, alcohol, sleep, skin condition, symptom notes, pet condition, walks, and lifestyle information. These features are for personal tracking, journaling, and reflection only. They are not intended for medical diagnosis, treatment, prevention, veterinary diagnosis, driving decisions after drinking, legal compliance decisions, or emergency decisions. If you have health, alcohol, safety, or pet health concerns, consult a doctor, veterinarian, pharmacist, public authority, or other appropriate professional.
8. Automated, Estimated, and AI-Assisted Outputs
The Services may display estimates, suggestions, classifications, summaries, recommendations, or AI-assisted text or image-related output based on your entries, photos, location information, barcodes, purchases, or past records. These outputs are for reference only and are not guaranteed to be accurate, complete, current, or useful. You should review information yourself before making important decisions.
9. In-App Purchases and Subscriptions
Some Services may offer in-app purchases, paid features, ad removal, additional functionality, or subscriptions. Purchases are processed by the applicable app store, and pricing, taxes, renewals, cancellation, and refunds are governed by the store's terms and procedures. Subscriptions may renew automatically unless you cancel them.
Subscriptions offered through the Apple App Store are associated with your Apple ID. After cancellation, you may continue to use the applicable paid features until the end of the current billing period. If you would like to request a refund, please use Apple's refund request page or the applicable store's prescribed process. Refund eligibility and amounts are determined by the applicable store's rules and decision, not by us.
10. Third-Party Services
The Services may use third-party services such as Google AdMob, Apple App Store, Google Play, Apple iCloud/CloudKit, and email or support-related services. Third-party services are governed by their own terms, privacy policies, and operating conditions. 11. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, process, and share information. By using the Services, you consent to the information practices described in the Privacy Policy.
12. Disclaimer of Warranties
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, continuity, data storage, sync, backups, ads, purchases, notifications, location features, photo processing, and third-party integrations.
13. Limitation of Liability
To the maximum extent permitted by law, Studio POMEKURI will not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of data, inaccurate records, missed notifications, business losses, or outcomes related to health, safety, driving, pet care, inventory, household expenses, subscriptions, or maintenance decisions arising from your use of or inability to use the Services.
14. Changes and Termination
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date on this page. Continued use after changes constitutes acceptance. We may suspend, restrict, or terminate all or part of the Services if you violate these Terms, if required by law, or if necessary for operation of the Services.
If we discontinue a Service or a specific paid feature, we will make reasonable efforts to stop new purchases and automatic renewals after the service end date. Any already paid period will be handled according to the rules and procedures of the Apple App Store, Google Play, or other applicable store.
15. Governing Law
These Terms are governed by the laws of Japan, without regard to its conflict of law provisions.
